The documents set out in this section govern your dealings with Rex Crystal Fixings Ltd. Please read them carefully. They do not affect your statutory rights.

This document is separated into two sections. Section 1 Covers Terms and Conditions of the purchase of Goods from us, Section 2 Covers the Terms and Conditions and the Terms of Use of our Website and Digital Services that we provide.

The Terms and Conditions detailed on our website apply to Powertoolsgb and Rex Crystal Fixings Ltd. 

SECTION 1

Terms & Conditions

Introduction In these Terms of Use, references to “we”, “us” or “our” (or words of similar import) means Rex Crystal Fixings Ltd. Powertoolsgb.co.uk is owned by Rex Crystal Fixings Ltd and the Terms and Conditions are applicable to Powertoolsgb.co.uk and Rex Crystal Fixings Ltd. The terms “you” and “your” refer to the person or organisation to whom we supply goods and services.

The term “contract” refers to your order for the sale or purchase of goods and services. These Terms and Conditions are incorporated into all Contracts unless specifically agreed in writing by us. The Terms and Conditions do not affect your statutory rights. The Laws and Courts of England shall have exclusive jurisdiction over these Terms and Conditions. By placing an order and making payment you accept these Terms and Conditions and such actions shall be conclusive evidence of acceptance.

We reserve the right to alter these Terms and Conditions without notice and shall apply to all orders placed, and Contracts entered into after the introduction of the amendments.

Pricing and Payments

Price on our website are show with both the excluding VAT and the VAT amount, VAT is applicable in all transactions unless it is an exempt purchase, it is the responsibility of the customer to prove that the VAT is exempt or that there is some other provision which applies. We reserve the right to refuse to exempt goods from the application of VAT. Whist every effort is made to ensure the accuracy of pricing and product description displayed on our website or advertising material, mistakes and errors may occur; in the event of an error or mistake your order will be suspended or cancelled, upon which we will contact you to discuss the options. If we are unable to contact you we will cancel your order. We reserve the right to change product details, specifications and prices without notice.

By placing an order via our website you authorise us and our merchant services provider to take payment for the products, you should satisfy yourself of the merchant service providers individual Terms and Conditions as well as their Privacy Policy prior to placing your order or providing any personal details or payment details, if you are not happy with the Terms and Conditions or privacy policy of the merchant service provider please do not place an order.

Deliveries, Returns and Cancellations

All products are supplied subject to availability. In the event of an ‘out of stock’ situation we will inform you of the delay. If there is a delay that exceeds 30 days we will cancel your order unless we have agreed otherwise with you.

Powertoolsgb Terms of Service

 

Due to the nature of the equipment we sell,  we only sell to businesses, construction trade, building crafts or trade professionals such as plumbers, electricians, joiners etc.  Our equipment requires specialist knowledge and skills to use and as such we choose not to sell to hobbists, or people performing DIY tasks etc via our website. By using our website or making a purchase from our website, you accept and acknowledge that you are purchasing in the course of your trade,  business, craft or profession.  Your rights to refund and return are therefore different to those of a consumer and as such you should not purchase from us if you are intending to purchase as a consumer as we do not consent to selling to consumers. If you are a consumer and purchase via our website  you are fraudulently misrepresenting yourself as a trade or business as set out in this notice. Buying an item on behalf of a trade or business is deemed to be purchased for a trade or business and again is not covered by rules relating to consumers.  

 

If you are a consumer and adamant that you  wish to purchase from us, please attend our store where you can browse our product range at leisure, speak with one of our sales team and see the goods before deciding whether to purchase.  

Purchasing as a Limited Company, Business, Trade, Craft  or a building Professional such as a Plumber, Electrician, Joiner or similar ? 

 

Please note, you are not a consumer for the purposes of a refund. Our products are professional construction products, accessories and associated items,  you are therefore not able to return your items to us under the Consumer Contracts (information, Cancellation and Additional Charges) Regulations 2013, these regulations replaced the Consumer Protection (Distance Selling Regulations) 2000. This means that you won’t be offered a refund if you change your mind about your purchase when you receive your goods. 

In limited circumstances we will may provide a refund or exchange, you need to contact us, the easiest way is to telephone or email us and explain your circumstance and we will consider your request. 

Warranty Claims

In the event of needing to claim under the manufacturers warranty, please contact us on 0800 210 0621 during office hours and we will deal with the situation. If we are closed for Christmas you should contact the warranty provider direct to make your claim. We can only assist you with products that have been purchased from us, if you purchased your item from another retailer we will not be able to assist you. Warranty claims will only be considered for items that have been used in accordance with the instructions for use, items that have not been reasonably cared for or whether the product has been used for a purpose other than that advised for by the manufacture will not be considered, neither will claims where the product visually appears to have been abused and such abuse could have lead to the fault that is being experienced.

Introduction

In these Terms of Use, references to “we”, “us” or “our” (or words of similar import) means Rex Crystal Fixings Ltd.

In these Terms of Use, references to “you” means the person accessing and using our Digital Services (as defined below). If you use our Digital Services on behalf of a company, organisation or other entity, then (i) you includes you and that company, organisation or other entity, and (ii) you represent and warrant that you are authorised to bind the company, organisation or other entity to these Terms of Use, and that you agree to these Terms of Use on behalf of yourself and the company, organisation or other entity.

These Terms of Use set out the basis on which you may make use of our Websites and our software and web-based applications (together, our Digital Services). By accessing and using our Digital Services, you are indicating your acceptance of these Terms of Use and you agree to comply with them. If you do not agree to these Terms of Use, you may not use our Digital Services. The supply of any goods, products or services you order through our Digital Services is subject to our applicable Terms and Conditions of Sale and any other relevant terms and conditions. Please note that product pricing on our Digital Services software and web-based applications may reflect the purchase price as advertised on our Websites, which may include any promotional offer(s) already taken into account.

We will use your personal information that we collect through our Digital Services in accordance with our Privacy Policy. We reserve the right to change these Terms of Use from time to time without prior notice by changing them on our Website. The Terms of Use applicable to your use of our Digital Services will be those in force at the time you access the Digital Services.

All copyright, moral ownership and other intellectual property rights in our Digital Services and the Material (and derivatives of it) are either owned exclusively by or are licensed to us or one of our affiliates. You acknowledge our (and our affiliates') rights to the Material. The rights granted to you under these Terms of Use shall terminate immediately upon your breach of any of these Terms of Use, and you must (at our option) return or destroy any copies of the Materials you have made.

Our Digital Services also contain certain of Rex Crystal Fixings Ltd’s (or an affiliated company's) trade marks (whether granted or applied for), graphics, logos and service names (collectively, Devices). The Devices are owned exclusively by us or the affiliated company and may not be copied or reproduced in any format (save as expressly provided elsewhere in these Terms of Use), or used in connection with any product or service without our prior written consent. All other trade marks not owned by us or our affiliated companies that appear on our Digital Services are the property of their respective owners, who may not be affiliated with, connected to, or sponsored by us or our affiliated companies and you must not use those trade marks without the permission of the respective owners.

User Generated Content

Certain features of our Digital Services may allow you to upload and publish materials, images, photographs, content and information to our Digital Services, create bespoke materials or designs, and/or save customised content (collectively, User Content). Where you upload, publish or otherwise store User Content through our Digital Services you are responsible for ensuring that you have any and all necessary rights, licences and permissions to use that User Content. We will not be responsible for any use of information, materials or content not provided by us. We reserve the right to remove or modify any User Content for any reason; including User Content that we believe violates these Terms.

Any User Content you upload to our Digital Services will be considered non-confidential and non-proprietary, and you grant us the right to use, copy, host, distribute and disclose to third parties the User Content. We also have the right to disclose your identity to any third party who is claiming that any User Content posted or uploaded by you to our Digital Services constitutes a violation of their rights (including their intellectual property rights or their right to privacy).

Without limiting the preceding paragraph, the User Content provided by you may be used: (i) to provide our services and/or goods to you; (ii) to help us develop and improve our Digital Services; and (iii) for the purpose of performing business and data analysis, and you grant us the right to use, copy, host, distribute and disclose to third parties the User Content for these purposes.

The views expressed by other users on our Digital Services do not represent our views or values.

Accuracy of Information

Our Digital Services are updated regularly, and content may change without notice. We are under no obligation to keep the Material up to date, and you acknowledge that it may be out of date at any given time. Material on our Digital Services is not intended to amount to advice or authority on which reliance should be placed. Without limiting the provisions of the section entitled Accuracy of information, our Digital Services may from time to time contain film Video Guides, and other guides (collectively, Guides) that are provided for general information and background purposes only. The Guides should not be relied upon as advice or as the sole source of information on how products operate or their correct use. Before commencing any task please: assess the risks associated with what you are about to do – taking any necessary precautions; and read and follow all manufacturers' and safety instructions relating to the equipment or products.

To the extent permitted by law, Rex Crystal Fixings Limited accepts no liability for any loss, damage or injury arising as a consequence of any reliance placed upon the Guides, whether by a user of our Digital Services or by anyone who may be informed of their contents.

In relation to the Video Guides, all references are correct at the time of filming.

We may from time to time establish links to the websites of manufacturers, bloggers, demonstrators, review sites or other websites through our Digital Services. Your use of those websites is subject to the terms of use and policies available on those websites. From time to time we may also establish relationships with third parties that will enable you to access the websites of such third parties directly through our Digital Services. Where our Digital Services contain links to other websites and resources provided by third parties, these links are provided for your information only. Liability

If you are acting as a consumer:

If you are acting as a consumer (which for these purposes means anyone who acts outside the course of a business, trade or profession) in your use of our Digital Services, to the extent not prohibited by law, we accept no liability for any:

  • Loss which is not foreseeable (loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you started to use our Digital Services);

  • Business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses).

If you are acting in the course of a business, trade or profession) in your use of our Digital Services (a business user), we accept no liability (whether arising in tort (including negligence), contract, for breach of statutory duty or otherwise) and offer no promises or assurances in relation to our Digital Services or their content (including the Material), to the fullest extent such liability, promises and assurances can be excluded by law, and to the fullest extent permitted by law, all promises, assurances and other terms implied by law are excluded. For the avoidance of doubt, we shall have no liability to compensate you in relation to your use of our Digital Services or their content (whether arising in tort (including negligence), contract, for breach of statutory duty or otherwise), except for any refund we make under any other agreement between us or otherwise at our discretion. If you are acting as a business user in your use of our Digital Services, without prejudice to the preceding paragraph, we accept no liability (whether arising in tort (including negligence), contract, for breach of statutory duty or otherwise) for any of the following losses:

You may not assign or transfer your rights or obligations under these Terms of Use.

Except as expressly stated, a person who is not a party to these Terms of Use shall not have any rights under or in connection with these Terms of Use by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

Subject to the following paragraph, you and we agree that these Terms of Use are governed by the law of England and Wales and that any dispute between you and us arising out of or in connection with these Terms of Use (including non-contractual disputes or claims) will only be dealt with by the courts of England and Wales.

Regardless of the above paragraph, you and we agree that if:

you are a consumer (as defined in the Liability section) regardless of your place of residence, the laws of England will apply to these Terms of Use and any dispute between you and us arising out of or in connection with these Terms of Use (including non-contractual disputes or claims) will be dealt with by the Courts of England, the Laws and Courts of England having exclusive jurisdiction to Govern these Terms of Use.

Our telephone calls are recorded and retained in accordance with Data Protection regulations, we use this information for the prevention of crime, to improve our customer service and for any other purpose that might arise in the general course of our business. The content of calls or the recordings may be shared with third party agencies engaged in the prevention of crime, those who investigate fraud within an organisation which we work with  or who provides a service to our organisation, we may also use the information in the resolution of customer complaints, dispute resolution or similar matters. Please be assured that we only use this information when necessary and as such it is in place to protect us as an organisation, our employees and the public. 

Our premises utilise CCTV, there may also be sound recorded as well as images when you attend our premises. We record and retain this data in accordance with Data Protection regulations.  We use these recording for the prevention of crime, to improve our customer service and for any other purpose that might arise in the general course of our business. The content of may be shared with third party agencies engaged in the prevention of crime, those who investigate fraud within an organisation which we work with  or who provides a service to our organisation, we may also use the information in the resolution of customer complaints, dispute resolution or similar matters. We also use this to protect the welfare of our staff, we have a no abuse policy and do not tolerate abuse or harassment of our staff. Please be assured that information or footage obtained from our CCTV when necessary and as such it is in place to protect us as an organisation, our employees and the public
